Terms of Service

1. Service Description

OSHACheck (“the Service,” “we,” “us”) provides a web-based platform that enables users to search and retrieve publicly available records from the US Department of Labor Occupational Safety and Health Administration (OSHA) enforcement database. OSHACheck aggregates and displays government records for informational purposes only.

The Service is operated by OSHACheck and is available at oshacheck.org. By creating an account or using the Service, you agree to these Terms of Service.

2. Data Sources and Accuracy

Data sourced directly from the federal OSHA enforcement database maintained by the US Department of Labor. OSHACheck does not verify, supplement, or guarantee the accuracy of government records. Results are for informational purposes only and should not be used as the sole basis for any business, hiring, underwriting, or legal decision.

Records displayed on OSHACheck are retrieved from the US Department of Labor OSHA Enforcement Database and are provided pursuant to the Electronic Freedom of Information Act. OSHACheck does not modify, supplement, or editorialize government records in any way.

Data currency depends on the federal government’s update schedule. OSHACheck makes no warranty regarding the timeliness of records displayed.

3. Permitted Use

You may use the Service for lawful business purposes including insurance underwriting, contractor screening, legal research, and compliance due diligence. You may not use the Service to:

  • Harass, discriminate against, or defame any employer or individual
  • Republish or resell raw data without attribution to the US Department of Labor
  • Attempt to scrape, reverse-engineer, or automate unauthorized access to the Service
  • Use results as the sole basis for employment decisions in violation of applicable law

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OSHACHECK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF, OR INABILITY TO USE, THE SERVICE OR THE DATA PROVIDED THEREIN.

OSHACHECK’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO OSHACHECK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. OSHACHECK EXPRESSLY DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

5. Dispute Process

If you are an employer or authorized representative and believe that a record displayed on OSHACheck contains an error, you may submit a dispute using the “Flag Record” feature on any search result page.

Important: OSHACheck does not modify government records under any circumstances. Submitted disputes are noted alongside the affected record for reference by subsequent viewers. To correct the underlying government record, you must contact the US Department of Labor directly at osha.gov.

6. Payments and Refunds

Subscription fees are billed in advance on a monthly basis. Pay-per-report purchases are non-refundable once the search has been executed and data retrieved. Subscription plans may be cancelled at any time; cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused credits.

7. Governing Law and Arbitration

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Tarrant County, Texas. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. You waive any right to a jury trial or to participate in a class action lawsuit or class-wide arbitration.

8. Changes to Terms

OSHACheck reserves the right to modify these Terms at any time. We will provide notice of material changes by email or by posting a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
